(1) In this Act, unless the contrary intention appears: (a) artificial insemination; and (b) the implantation of an embryo in the body of a woman. (2) The fact that an application is heard or dealt with in contravention of subsection (1) does not affect the validity of an order made, or the effectiveness of a consent given, upon the application or the re‑hearing of the application or make ineffective any dispensation with a consent granted on the application. (a) in relation to a foreign country: (i) any authority that is prescribed in relation to that country by regulations made for the purposes of this paragraph; or (ii) any other authority that is competent, under the law in force in that country, to issue the original or a certified copy of a certificate, entry or record of a marriage solemnised in, or under the law of, that country; and (b) in relation to a part of a foreign country: (i) any authority that is prescribed in relation to that part of that country by regulations made for the purposes of this paragraph; or (ii) any other authority that is competent, under the law in force in that part of that country, to issue the original or a certified copy of a certificate, entry or record of a marriage solemnised in that part of that country. This Act shall not be taken to exclude the operation of a law of a State or of a Territory, in so far as that law relates to the registration of marriages, but a marriage solemnised after the commencement of this Act is not invalid by reason of a failure to comply with the requirements of such a law. (8) In the month of January in each year, a chaplain by whom, or in whose presence, a marriage has been, or marriages have been, solemnised in the preceding year shall forward to the Registrar, in accordance with the prescribed form, particulars of that marriage or those marriages.

(3) Where an Act, a State Act or an Ordinance of any Territory of the Commonwealth provides that a person specified in the Act, State Act or Ordinance is to be the guardian of a minor, or requires that a specified person is to be deemed to be the guardian of a minor, to the exclusion of any parent or other guardian of the minor, that person is the person whose consent is required by this Act to the marriage of the minor.
